TEXANS PETITION SECRETARY OF STATE TO DISCONTINUE ILLEGAL COUNTY WIDE POLLING PROGRAM (CWPP)
FOR IMMEDIATE RELEASE: APRIL 18, 2023
WE THE PEOPLE of Texas, in Medina, Williamson, Harris, Collin, Travis, Bexar, Fort Bend, Hays, Montgomery, Grayson, Burnet, Gillespie, Tarrant, Taylor, Dallas, Collin, Wichita, Potter, Denton, Bastrop, Kendall, Guadalupe, Brazos, Parker, Smith, Nueces, Atascosa, Bell, McClennan, Comanche, San Saba, Bosque, and many other COUNTIES stand together to PETITION the TEXAS SECRETARY OF STATE for remedy and relief from illegal voting systems and programs conducting our elections.
Honorable Secretary of State, Jane Nelson and Christina Adkins, Director of Elections MUST DISCONTINUE THE SOS COUNTY WIDE POLLING PROGRAM (CWPP) IMMEDIATELY for generating unknowable and unrecoverable elections.
Where as Texas Election Code, 122.001 (a) (1-10), clearly defines the type of voting systems that MAY NOT be used to conduct our elections:
(a) A voting system may not be used in an election unless the system:
(1) preserves the secrecy of the ballot;
(2) is suitable for the purpose for which it is intended;
(3) operates safely, efficiently, and accurately and complies with the voting system standards adopted by the Election Assistance Commission;
(4) is safe from fraudulent or unauthorized manipulation;
(5) permits voting on all offices and measures to be voted on at the election;
(6) prevents counting votes on offices and measures on which the voter is not entitled to vote;
(7) prevents counting votes by the same voter for more than one candidate for the same office or, in elections in which a voter is entitled to vote for more than one candidate for the same office, prevents counting votes for more than the number of candidates for which the voter is entitled to vote;
(8) prevents counting a vote on the same office or measure more than once;
(9) permits write-in voting; and
(10) is capable of providing records from which the operation of the voting system may be audited.
(b) Repealed by Acts 2017, 85th Leg., R.S., Ch. 404 (H.B. 25), Sec. 8, eff. September 1, 2020.
(c) The secretary of state may prescribe additional standards for voting systems consistent with this title. The standards may apply to particular kinds of voting systems, to particular elements comprising a voting system, including operation procedures, or to voting systems generally.
Where as we Texans, through public information act requests, discovered the County Wide Polling Program is not suitable for the purpose for which it is intended;
Where as we Texans, through public information act requests, discovered that the County Wide Polling Program and voting center model is NOT safe from fraudulent or unauthorized manipulation;
Where as we Texans, through public information act requests, discovered the County Wide Polling Program and electronic voting systems ARE NOT operating safely, efficiently, and accurately and they DO NOT comply with the voting system standards adopted by the Election Assistance Commission;
Where as we Texans, through public information act requests, discovered the County Wide Polling Program, and county wide voting systems, DO NOT permit voting on all offices and measures to be voted on at the election;
Where as we Texans, through public information act requests, discovered the County Wide Polling Program and voting center equipment DO NOT prevent counting votes on offices and measures on which the voter is not entitled to vote;
Where as we Texans, through public information act requests, discovered the County Wide Polling Program voting center model DOES NOT prevent counting votes by the same voter for more than one candidate for the same office or, in elections in which a voter is entitled to vote for more than one candidate for the same office, prevents counting votes for more than the number of candidates for which the voter is entitled to vote;
Where as we Texans, through public information act requests, discovered the County Wide Polling Program DOES NOT prevents counting a vote on the same office or measure more than once;
Where as we Texans, through public information acts requests and research on previous voting precinct model used for 100's of years, the County Wide Polling Program and voting center model electronics ARE NOT capable of providing records from which the operation of the voting system may be audited because the voting center model has to meet the first standard of protecting the secrecy of the ballot, there is no audit log, or meaningful way to audit what ballot a voter actually received, marked, and cast, only an audit log of the ballot the voter was supposed to have received;
Where as we Texans, through public information act requests, discovered the ballot definition files miscoded, sample ballot definitionfiles miscoded, bar codes misprinted and miscoded, ballot printer software deficiencies, and ballot style serial numbers were all malfunctioning causing voters to receive, mark, and cast a ballot containing candidates and measures not intended for them; denying opportunity to vote for candidates and measures intended for them;
Where as we Texans, through public information act requests, discovered that voters were being denied the opportunity to vote for candidates and measures intended for them;
Where as we Texans, reviewing the Texas Election Code 122.001 (c) clearly states that the Secretary of State may create a COUNTY WIDE POLLING PROGRAM as long as the standards are CONSISTANT with the standards listed above and they ARE NOT;
Where as we Texans, through public information act requests, obtained the 11/2020 Joint General Cast Vote Records from Williamson County in March 2021 and discovered they did not reconcile with other election records;
Where as we Texans, UNDER ARTICLE ONE, SECTION TWO, OF THE TEXAS CONSTITUTION, as our birthright, WITH ALL POLITICAL POWER BELONGING TO US, have the right to RESTORE, ABOLISH, AND/OR REPLACE any voting system that FAILS to meet the requirements of theTexas Election Code and BENEFIT THE PEOPLE OF TEXAS;
Where as County Wide Polling Program has destroyed confidence for the last DECADE, We the People of Texas, DEMAND the Texas Secretary of State, County Clerks, County Election Administrators, Sheriffs, Tax Assessor Collectors, County Chairs, and our Texas County Commissioners, MUsT DISCONTINUE the COUNTY WIDE POLLING PROGRAM AND ANY OTHER VOTING SYSTEM that fails to meet the mandatory standards listed in this petition;
Where as the only secure, accurate, transparent, and accountable way to conduct elections is in the voting precinct, with no more than 2000 pre-printed paper ballots hand marked and counted in voting precinct, where as ONE ballot style is offered per voting precinct for no more than 2000 reg. voters, where paper pollbooks voting system with the voting precinct Election Judge signing the back of each ballot, is the ONLY way to audit the voter received, marked, and cast the correct ballot, we ask for any voting system that fails to meet the strict standards be decertified and discontinued;
WE THE PEOPLE OF TEXAS, prayerfully ask the Secretary of State, Mrs. Honorable Jane Nelson, daughter of Texas, to remedy this incredible injury to the people of Texas, and restore INTEGRITY to our most foundational, our most CRITICAL system, immediately discontinuing the County Wide Polling Program, and decertifying all electronic voting systems that fail to meet the very strict voting system standards set forth in Texas Election Code 122.001 (a.) (1-10).
We pray the Texans in postion to remedy this injury, that will God bless you and guide you, may He give you courage to do what is right and in the best interests of WE the PEOPLE of this GREAT STATE of TEXAS.
